1. The OUCH test is a rule of thumb you should use whenever you are contemplating any employment
action. Think of a recent employment action that was in the news or a recent employer action your
employer took. Can you identify a step that was missing in this employment action from the OUCH test?

3. Diversity is not law, nor necessarily even policy within organizations. Do you believe that the federal
or state governments should create laws mandating diversity in organizations? If so, what would be
included in these laws? Either way what policies do you believe organizations can enact to increase
diversity?
