Religious Discrimination
1. Freedom of Religion is guaranteed by each state under the 1st Amendment.
2. Religion can be a BFOQ.
3. Accommodating religious beliefs is required unless it presents an undue burden to the
employer.
4. An employer is entitled to know of the employee’s religious beliefs before granting an
accommodation.
5. The wearing of religious clothing is protected unless it presents an undue hardship.
6. During employment wearing a gold cross which can be seen by others is permissible.
7. An employee’s desire to live in an active religious community which is a significant distance
from the workplace does present an undue hardship to the employer.
8. The KKK is both a political and a religious organization.
