a.) Void for vagueness is when a law is written and someone with an average intelligence
level must guess as to the meaning of the law or is unsure the full meaning. This is a
problem and could be a work around the criminal justice system.
b.) The overbreadth doctrine is the opposite of void for vagueness. It is where it is described
in so much detail that it infringes on our individual rights as citizens and deemed
unconstitutional. It is not an intentional doing, and without meaning to it violates some of
our constitutional rights.
c.) Between “Void for Vagueness” and the “Overbreadth doctrine”, it is like looking at one
extreme or another. Due process protects that by placing a minimum standard on the
fairness of a crime. Chapter 1 of Criminal Law: Purposes, Scope, and Sources uses
traveling out of state as an example. It says that the state cannot make it a crime to leave
the state because of our right to travel. However, you cannot leave the state while caring
for a child or it will be considered child abandonment. Due process is the net for
Vagueness and overbreadth doctrines.
2.) The three branches of our government are Legislative, Judicial, and Executive. Our
Judicial branch is responsible for deciding how laws are applied and if they are a violation to our
constitution as well as determining the definition and defining laws. The Executive branch is
responsible for implementing laws as well as enforcing them. The Executive branch is composed
