Summary
A terminally ill patient and his wife fought against the government’s interference with the
interstate shipment and sale of a drug that was approved for distribution by the Federal Food,
Drug, and Cosmetic Act, Laetrile. One of the sections of that Act prohibits the distribution of any
new drugs without the approval of the Secretary of Health, Education, and Welfare; the approval
