Hello classmates,
This week’s forum gives me an opportunity President Trump’s recent executive order. It
becomes a unique case because immigration and national security go hand-in-hand. The question
that many American’s propose is was this legal and what is going to be the courts response to
this matter? We must first understand what the federal court system is and how it works. The
Federal Court is a court of limited jurisdiction. For example, they can only hear cases authorized
by the United States Constitution or federal statutes. The starting point for any case arising under
federal statutes, the Constitution, or treaties will be heard in the Federal District Court,
("Introduction To The Federal Court System | USAO | Department of Justice," n.d.). They only
hear cases that are authorized by the United States, Constitution or federal statutes.
Given a little background on the federal court system, the question many American’s ask
is was the executive order President Trump signed legal? As per U.S. Code 1182 section (F)
Suspension of entry or imposition of restrictions by President states: ” Whenever the President
finds that the entry of any aliens or of any class of aliens into the United States would be
detrimental to the interests of the United States, he may by proclamation, and for such period as
he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or
nonimmigrant’s, or impose on the entry of aliens any restrictions he may deem to be appropriate
(Cornell University Law School, n.d.).
With that being said, the executive order is legal and the constitution provides the United
States President with constitutional authority to keep America safe from foreign threats to
