Plaintiffs are patrons of North Central Regional Library District who uses or has used
computers made available to public by North Central Regional Library District to access the
internet. Plaintiffs were unable to access certain websites relation to youth tobacco usage
while conducting internet research regarding alcohol and drug-addiction topics in connection
with academic assignments. Plaintiffs Internet research on art and health related topics
resulted in denial of access by defendant’s internet filtering system. Access to various dating
sites including personals section of craiglist.org was also prevented. Plaintiff denies having
seen a “Material Selection Review Form”, a form that defendant library makes available to
patrons requesting to unblock specific websites. Plaintiff attempted to access
www.womenandguns.com but was prevented from doing so by defendant’s internet filtering
system. Before the matter presented in the court, the defendant did not receive any report that
access to the specific website was blocked and does not content that the website should be
blocked. Internet access through the defendant’s internet network is subject to two policies: the
Internet Public Use Policy and the Collection Development Policy. The Collection Development
Policy is based on the principles that defendant’s materials shall be selected and retained in
the library on the basis of their value for the interest, information, and enlightenment of all the
