Special Courts
Where there is no publicity, there is no justice. Publicity is the very soul of
justice. It is the keenest spur to exertion and the surest of all guards against
improbity. It keeps the judge himself, while trying, under trial.

In Class we
focused on this statement and in relation to the medias freedom of expression
within the jurisdiction of the principal courts. This was limited by the
reporting restrictions that are in place to protect other rights that the accused
and participants have. These included protecting the right to a fair trial, right to
fair civil proceeding, right to privacy of an accused, victim or parties involved.
These were covered by interim name suppression, permanent name
suppression, suppression of other details identifying the accused or witnesses.
The purpose here is to identify different limitations that are put on media in
reporting proceedings in special courts.
