I thought last weeks discussion board was really interesting. I’m sure that it can come up more
than you would like in criminal law. I was told the incomplete only lasted for an extra 10 days as
I’m getting one in my other class since I could not catch up totally in all three classes I’m taking.
Off topic but if your graduating class was 88 you look amazing! My birth year is 84 and I
thought you were only a couple years older than I am. During PSI the defendant doesn’t have the
right to counsel. During a PSI mitigating circumstances can be given. The defendant does have
the right to counsel during the sentencing hearing. The facts during sentencing hearings are most
commonly done by preponderance of the evidence. Victim impact statements are controversial.
