1. The four sources of law are Constitutional, Judicial, Legislative, and Administrative. In my
professional career I have been most affected by Administrative Law. I have undergone a
USDOT audit and an OSHA audit. As VP for an electrical contracting company I am now
guided by the NEC with is under the NFPA. Additionally I see Legislative law as a strong force
affecting my business. As VP I have found every elections brings about new laws that strongly
affect our small business proceedings.
2. Two years ago I talked the task of rewriting our companies handbook. One of the leading
points of the mission statement included how we as a company view all of our customers as a
part of our company. The idea is for our employees to treat everyone (our stakeholders) as if
they were a crucial part of the company and that by treating them this way it insures returning
business and revenue. We pass this revenue back to the employees in the forms of bonuses. In
short a business first responsibility is to make a profit; however, if you do not respect everyone
in that process there will not be any future gains. Always keep the long-term goals in sight!
3. Mediation and arbitration are two forms of alternative dispute resolution involving a neutral
third party. They both offer a less expensive and private (unless court ordered) option as
opposed to litigation. Arbitration and mediation (mediation being the lesser of the two) are also
less formal and allow the two disputing parties more control over the hearings. Arbitration;
however, is binding as opposed to mediation which only offers suggestions for resolutions.
Mediation has no set time limit, which could become a negative result.
