Procedure History: Ms. Helen Palsgraf, the plaintiff, filed a lawsuit against the defendant, Long
Island Railroad Company regarding the company’s negligence in the injury sustained by
fireworks that went off when another passenger’s unmarked package fell off when he was trying
to board a moving train. The trial court and the intermediate appellant court found that the
defendant was right in her lawsuit and the railroad company had acted negligently, which led to
the injuries sustained by the plaintiff. The defendants then launched their appeal to Courts of
Appeals of New York and won the case.
