In the opening statement of Obergefell v Hodges, the majority makes mention of the
promises of the constitution, and attempts to convince its audience that the constitution is a living
and breathing document. The minority makes a contrasting comment that the duty of the court is
to decide cases on what the constitution is and not what it should be. The majority says that the
liberties prescribed in the constitution allow people to define and express self-identity thereby
prompting them to try, discover and pursue, by study or experiment, the liberty to marry someone
of their same sex and enjoy a legalized marriage as do heterosexuals. The minority begs to differ
and makes two assertions. One, that the SCOTUS is not a legislature concerning itself with whether
homosexual unions are a good idea and two that the right to marry does not mean that a State needs
to change their definition of marriage. Both sides show degrees of credibility, logic and emotion.
Regarding credibility, the Code of Conduct for United States Judges states that a judge
