FACTS:
• The plaintiff, Dr. Hodge, is a physician
• The defendant had been the plaintiff’s patient for a number of years
• On the contract date, the defendant was seventy-five years of age, was afflicted by grievous
chronic illnesses, and required constant medication and frequent medical attention
• The contract was prepared and executed in Dr. Hodge’s medical office on August 19, 1965
• Mr. Shea was admitted to the hospital on August 21, where he remained until August 25
• Mr. Shea and Dr. Hodge had a personal relationship
