Statements of Facts: Marbury was nominated by late President of the United States, John Adams,
to a justice of the peace position. Although, signed and sealed, the commissions were not
delivered. New coming President Thomas Jefferson’s secretary of state, James Madison, did not
comply the requests of the applicants to have their commissions delivered. Later, Jefferson
decided that the commissions were invalid due to them not being delivered until he held office.
