Our national constitution was adopted over two-hundred years ago. Throughout the
years, small amendments have been made to it in order to stay up to date with the
always-changing times. We have been adapting it to stay with the times. An originalist
constitution view is one where someone feels that the constitution should not change. A living
constitution is one that changes and adapts to new circumstances. It evolves over time to keep
up with the world.
If I were on the Supreme Court, I would adopt a living constitution approach. I believe
that marriage should not just be between a man and a woman. I believe that the government
should not have a say in abortion and whether or not a woman wants to go through with the
procedure. Ultimately, it is the woman’s choice and elderly white men should not be able to tell
people how to use their bodies. Our nation has too many problems to be fixed to be worrying
about things like marriage and abortions.
But we should also stick to the foundations of the constitution on some aspect. Guns are
a big problem when we think about our nation. Over the years, guns have caused many issues.
The right to bear arms should not be overwritten. I believe that that amendment should stay but
more control should be applied. A living constitution can also have its setbacks. Whoever is
making the changes can manipulate the constitution and can alter it to his or her own ideas of
what it should look like. The good thing is that changes must be voted on so any changes too
drastic will not pass. Overall, I still believe that a living constitution is a good idea.
There are a lot of factors that must be assessed when thinking about the constitution.
Our population throughout the nation has grown dramatically, technology has changed, our
relationships with international countries have changed, and socially, our world has changed. An
