In this paper, I will be discussing concerns to legal and ethical issues surrounding marketing and
product safety and intellectual property.PharmaCARE is a distribution medical company that has
gained high profits through the sale and manufacturing of AD23 and even therefore they were
signs around the medical side effects such as Alzheimers Disease and in some cases death such
as in John’s wife life. The paper will discusses the direct to consumer marketing, potential legal
and medical risks of the drug as well as actions that need to be taken to address some issues that
the senior partners are not aware of. This article will analyze how PharmaCARE has used US
laws to protect its intellectual properties. The paper will also look at how the indigenous people
of Colberia were compensated or not and ways in which John who lost his wife to the same drug
could be compensated as well.
Ethical Issues:
The three main ethical issues associated with marketing, advertising, intellectual property and
regulation of product safety include price, market and audience. The price for such drugs can be
sold at a higher premium and it neglects the producers from benefiting with the high profits and
also leaving out the consumers who have to spend a lot on such drugs without being properly
informed of their side effects.The distribution company shareholders of PharmaCARE are the
only ones who stand to gain from the distribution of AD23.The second unethical issue associated
with marketing and advertising of AD23 is that the audience are made to believe wrongful
information and due to PharmaCARE lack of research and follow up before launching and
distribution of the drug without the consent of FDA,audience are facing life threatening health
issues and in some cases such as that seen of John’s wife leading to her death.Lastly,market is a
big issue as well due to the fact that the drug being marketed is never been tested or FDA

approved for distribution but PharmaCARE has gone behind the agency to illegal distribute and
manufacture such drug. These unethical conducts can lead to numerous lawsuits filed against
PharmaCARE.
Direct-To-Consumer:
Direct to consumer offers the flexibility for pharmaceutical companies to be able to cut off the
middle man and market directly to the people. There are benefits as well as harmful effects to
both the consumer and the pharmaceutical companies. We will explore both side of the spectrum.
When marketing and distributing directly to the consumer, the pharmaceutical companies have a
more direct involvement and can be in a better position to diagnose and recommend a drug to the
consumer however pharmaceutical companies do not possess nor carry licenses to prescribe a
patient with a drug therefore they can misdiagnose a patient which could lead to a long term
