Harrison v. Family Home Builders, LLC

Facts:
The Harrisons and Family Home Builders (FHB) entered and signed a
contract whereby FHB agreed to do a remodeling and for additions of bedrooms, bathrooms, an
outdoor kitchen, an outdoor pavilion, and the installation of a concrete pad on January 5, 2007. Gean
who was a subcontractor for FHB as well as the supervisor for this project, met with the
Harrisons. The contract had no speci&c date of completion and did not say that time
was of the essence. Gean did advise the Harrisons that the estimated time of
completion was about 4 months with a cost of around $109,000. The Harrisons were
required to pay all of the costs of the work plus 13% contractors fee. FHB was required
to follow the plans and details provided by the Harrisons and comply with any applicable
codes. The Harrisons state FHB breached the contract by failing to complete the job,
negligence, fraud and faulty workmanship. FHB disagreed stating changes in the
speci&cations caused delay and additional time to complete. The Harrisons terminated
the contract and hired another company to complete the work. The trial court ruled in
favor of FHB. The Harrisons appealed the decision and it was reversed.
