Nature of the Original Action: Complaint for Payment of Principal Obligation
FACTS
Ma. Luisa Pineda (Pineda) filed a proceeding in June 2005 seeking payment of her
principal debt of Zuniga (Zuniga). Many real estate mortgages through all buildings and
improvements. Zuniga was asked but didn’t pay. Obligation earned interest totaling
232,000 pesos.
Zuniga denied Pineda’s allegations, arguing that the complaint should be dismissed due
to the lack of barangay arbitration, and argued that interest rates were inadequate. Zuniga
further denied having secured Zuniga’s loan, arguing that the amount was the cumulative
amount of another commitment she had made from Pineda in 2000. Pineda later admitted
that the amount was actually from the original 200,000 Philippine peso loan that earned
interest.
