Introduction
The dispute between Karen Jackson, plaintiff, and Marketing Homes Corporation, defendant, was presented to
the Court in order to provide a resolution to their issue of breach. The dispute between the plaintiff and the
defendant is on the question of performance. The Courts ruled in the favor of Marketing Homes Corporation
based on substantial performance doctrine and award the plaintiff damages for the price of the floor but hold the
contract valid in part.
