USA v. Iraq
I. The Facts
a. After the end of the Persian Gulf War in 1991, the United Nations Security
Council imposed sanctions against the Iraqi Republic, which required Iraq to
divest itself of all weapons of mass destruction, placed strict limits on the items
that could be imported and exported, and allowed for the inspection and, if
necessary, impoundment of any cargo entering or leaving the country. In 1993,
UN arms inspectors, led by the United States military, seized a shipment of
nuclear weapons parts that were hidden in a trading vessel going from Iraq to
Cuba, a staunch supporter of Iraq against the UN sanctions. The sanctions were
lifted in 2003 following the overthrowing of Saddam Hussein in an invasion by
US forces, and the military claimed control of the government. The military
demanded that the US either return the seized nuclear weapons parts from ten
years prior, or reimburse Iraq the full monetary value of the parts. The US refused
to do either, arguing that an unstable country should not be retroactively granted
