The first one was against Libya which involved a Libyan student living in Morocco who applied to
the Libyan Consulate to pursue his/her studies in France. However, his/her application was
declined to the issue and the Libyan student was not able to travel. This was considered a
violation because the committee found out that this refusal was without any valid reason.!
Another one, on 28Th of April 2009 Canada was the defendant state. The Canadian applicant
claimed a violation of Article 13 as his application of his asylum was refused and he couldn’t take
his passport back to leave the country. !
Therefor, Once again the committee claimed this as a violation of Article 13 !
