Introduction and Procedural History
In this case Hobby Lobby, Inc sued Kathleen Sebelius and challenged the Patient
Protection and Affordable Care Act, which was later inherited by Sylvia Burwell due to the
resignation of Kathleen and renamed Burwell v. Hobby Lobby. The plaintiffs argued that the
requirement to provide contraceptives violated the Free Exercise Clause of the First Amendment
and the Religious Freedom Act of 1993. A preliminary injunction was denied by the district
court and this was affirmed by a two-judge panel of the U.S. Court of Appeals for the Tenth
Circuit. Relief was denied by the Supreme Court and an en banc hearing was filed by the
plaintiffs. The Court of Appeals reversed.
