Service Master Global Inc. is a company that provide inspection, repairs, cleaning, restoration,
Pest control services to the owners or investors houses and buildings. Service Master Global Inc.
employees deal with many buildings in day to day life in which some may contain asbestos.
Service Master Global Inc. is concerned that manufacturers who make houses with asbestos
equipment seek absolute immunity from accountability for their failure to take reasonable steps to
warn building owners or investors. Particularly, Construction companies are not taking any
responsibility for the asbestos equipment that they use in building construction.
SUMMARY OF ARGUMENT
ALS is failed in “Duty to Care” when it failed to warn the dangers of the material that was
recommended in their manual. Particularly, when the material will degrade by the heat that will be
produced by the ALS machine which result in release of harmful dust into the air which may cause
