Electronic commerce has grown a lot in the past years. Few states have have already
passed legislation to make the use of electronic documents and electronic signatures easy.
These same laws also allow electronic notarization or digital notaries on electronic
documents. Of course this is a new technology and there is so much to learn. The
American Association of Notaries, is putting into action a new program on Electronic
Notarization to allow notaries to provide these services in their specific state. Notaries at
each state should know their laws regarding electronic signatures. This is because many
states have different laws related to these signatures. (Joanna, p.1)
How it works:
For digital notary the steps are basically the same as the regular paper document notary.
The only difference is that the signatures on digital notary are electronic. The steps of
digital notarization are as follow: Require presence, Examine the document, Identify the
person, Complete the record book entry, Perform the national act, and Complete the
notarial certificate. First each signer must be present for the notarial act. This meaning they
will sit in front of a computer screen so sign the electronic documents. The next step is to
make sure that all the blanks of the document are completed before the notarization. This
documents can be sent to the parties involved to be reviewed before the notarization. Next
step is to identify the person, and this is similar to the paper notarization. Same types of
identification are needed for digital notaries.
