Suing for refund on construction job in the amount of $4,000
Counter suing for emotional distress in the amount of $4,000
The facts of the case
Dr. Allen was the defendants (John Scott) dentist, while in the office receiving dental work the
defendant overheard the plaintiff and her assistant discussing the bathroom remodel the plaintiff was
considering.
It was then that Mr. Scott told the Dr that he could help her out. He said he was a contractor and if she
would take care of his dental work at no charge, he would remodel her bathroom at no charge.
The bathroom remodel was estimated to be $45,000
The dental work was estimated to be $23,000
The Dr wanted her bathtub and shower replaced as well as new cabinets put in.
After meeting at the Drs house an ORAL AGREEMENT was made stating that John would supply all the
labor and the Dr would cover the cost of supplies.
