The two important court cases that supports the team
contract scenario paper are Mobil Oil Exploration and
Producing Southeast, Inc. v. United States and Jacob and
Youngs v. Kent.
The case of Jacob and Youngs v. Kent involved the issues
of material breach and substantial performance. Jacobs
and Youngs built a home for Kent. In the late stages of the
building process, Kent learned that some of the piping
was made in Reading which was Cohoes piping from
another manufacturer in contray to the conditions within
the contract. The wrong piping was discovered by Kent’s
architect which advised Jacobs and Youngs to remove the
incorrect piping. The piping was enclosed within the walls
yet demolishing of the walls would be expensive to repipe
over again. “JY claimed that the substitute pipe was the
same in terms of quality, appearance, market value, and
cost as Reading pipe. Thus, JY completed construction
but refused to fix the pipe mistake. Kent refused to pay
the remaining balance on the contract and JY sued to
recover the amount due. The court ruled in favor of JY
