1. What does the contract say about CM @ risk bid responsibilities, accuracy, and what is assumed
to know?
In section 2.2.3 it says, The Construction Manager shall have the right to rely on the maps,
surveys, drawings, data, or other technical information supplied by the Owner as it relates to
the accuracy of such maps, surveys, drawings, data, or technical information...The Construction
Manager shall promptly inform the Owner in writing of any discrepancy between the materials
provided by the Owner and actual conditions before proceeding with any facet of the work that
is in question due to such a discrepancy.
2. What 2 exhibits constitute the bid documents
In section 7.1.2 and 7.1.3 it states that “The Construction Manager’s Fee for his work and for
the supervision of the Subcontractors of any tier shall be as stated in Exhibit B and The General
Conditions shall be those items set forth in Exhibit C and will be billed on the basis as specified
in that Exhibit; monthly or lump sum, for the duration as needed.
3. Conflict between plans and specifications
In section 1.2.3 it states a conflict being “ The intent of the Contract Documents is to require
the Contractor to provide the highest quality of Work consistent with the design intent. Actual
or alleged conflicts or inconsistencies between the Drawings and the Specifications or other
Contract Documents shall be brought to the Owner’s Representative’s attention in writing,
prior to performing the affected Work. For segments of work performed by the Contractor or
subcontractors of any tier where compensation is of a Cost plus basis, the Owner’s direction
