Was Lisa Ocheltree sexually harassed?
Yes, Ocheltree was sexually harassed. Sexual harassment is defined as” unwelcome sexual
advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature
constitutes sexual harassment when submission to or rejection of this conduct explicitly or
implicitly affects an individual’s employment, unreasonably interferes with an individual’s work
performance or creates an intimidating, hostile or offensive work environment.” Ocheltree went
to her supervisors because the incidents made her uncomfortable therefore the advances were
unwelcomed. When the advances did not stop Ocheltree kept missing work and stayed in
constant contact with her husband because of these activities. Therefore, these advanced were
both unwelcomed and impacting her quality of work.

I do not agree at all with what the appellate court decided. If sexual harassment is defined as
mentioned above then Ocheltree proved all of the requirements. The activity must either create a
hostile environment OR an offensive environment OR impact the person’s work performance.
