Before this case reached the Supreme Court, it was originally seen in the New York Court of
Appeals where the Hill family sued Time Inc. and won. The case then moved onto The New
York Supreme Court after Times Inc. appealed the ruling of the lower court.
3. Context
The parties involved in this case are Time Inc. and James Hill. Time Inc. published an article
regarding the play, The Desperate Hours, that was a “reenactment” of the events that happened
to the Hill Family. Three convicts escaped from prison and took the Hill family hostage for 19
hours. The case was heavily present in the news and media. The Hill family believed that the
article published by Time Inc. was a violation of privacy and that the article included false and
misleading information that was not fact-checked. The objective of the Hill family was to prove
that Time Inc. violated the privacy law. While the objective of Time Inc. was to object to the
allegations made by the Hill family and prove that they did not violate any laws when publishing
the article.
