Mental Incompetence
Watching your parents suffer from any illness can be distressing, and having to admit
them to an assisted living center because they can longer take care of themselves is also painful.
Such was the case of Dorothy Drury. Ms. Drury suffered from dementia and chronic confusion
and when she was unable to take care of her own affairs her son admitted her to an assisted
living facility; however during admission the facility had Ms. Drury sign a residency agreement,
which included an arbitration clause. Unfortunately Ms. Drury suffered injuries at the facility a
tort was filed to recover damages. The facility asked the court to compel arbitration. Was
Dorothy bound to the residence agreement?
