1. Avery is looking for a new job and lists Sandra as a reference. When the new employer
calls Sandra she says some negative things about Avery, which she believes are true but
are false. Avery doesn’t get the job because of what Sandra said. Avery sues Sandra for
slander. Is Avery successful in her lawsuit? Why or why not?
In this case, Avery may not be successful in her lawsuit. Being that Avery and Sandra
did not sign any contract or even have a verbal agreement, Sandra had no obligation to
Avery. Also, Sandra did not know she was being dishonest, which is a risk with this
situation. If it wasn’t regarding employment, Sandra would not be able to use the
defense “I didn’t know it wasn’t true” she would be held liable anyway in some states.
2. Joanne publishes information about herself on Facebook that anyone can see. She later
realizes what she has done and removes the information. Barry, who doesn’t like Joanne
