In the case of Gerald Arrington, I think the will should be admitted to probate. This is
because the wife, Brenda was disinherited and was in the process of being divorced by her
husband. Also the witnesses could attest to the capacity of the decedent when he wrote the
will. He also did not want his ranch to be sold, which he was certain that the wife would do
if she inherited the range. Based on these findings I do not think the wife could contest the
will and the daughter should inherit as stated in the will.
Questions 13.
A murderer cannot inherit property from his victim. This is because statutes provide that a
person who murders a decedent cannot inherit from the victim by intestacy. Therefore
anyone who murders the decedent cannot inherit as was the case of Kent Van Der Vern
(1993) pg. 1182.
