Chapter 19 HWQN/1 There was a design defect in Sta-Rite Industries drain pump. There had
also been complaints prior to Peterson’s case. The previous customers had installed a safety
mechanism that overcame the fault of the drain pump and prevented any accident. However,
Peterson failed to install any safety mechanism, which made him prone to the accident. Thus,
Sta-Rite Industries was liable to Peterson for strict liability.
Chapter 19 HWQN/3 The vehicle was sold “as is”, with an accompanying statement clearly
identifying the risk falls on the buyer. The plaintiff still purchased the vehicle with an
accompanying extended warranty. The vehicle experienced several mechanical problems that
were fixed and honored by extended warranty. The plaintiff brought suit for breach of contract as
an implied warranty. Therefore, the items to consider here in briefing ones supervisor for an
opinion are in what constitutes a warranty, express warranty, and implied warranty. The first two
are expressed or assured based off the products quality and the sellers confidence in the product.
