Branham v Ford Motor Co. (Opinion)
In a “products liability” case that a plaintiff is seeking any type of recovery. Regardless
of any theory that said plaintiff must also establish three (3) things;
I. that he was injured by the product;
II. that the product, at the time of the accident, was in essentially the same condition
as when it left the hands of the defendant; and
III. that the injury occurred because the product was in a defective condition
unreasonably dangerous to the user.
