PROBLEMS:
1. Which of the following obligations is valid? If valid, when is the obligation
demandable in each case?
a. If the debtor promises to pay as soon as he has the means to pay;
The obligation is valid. This is considered by law as an obligation with a
period in which its obligation is subject to an indefinite period because the
debtor binds himself to pay when his means permit him to do so (Art. 1180).
If the debtor already has the financial means to pay and the creditor
discover it, the creditor must file an action in court to set a period, and when
that period is reached, the debtor’s obligation to pay becomes
demandable (Art. 1197).
b. If the debtor promises to pay when he likes;
The obligation is not valid. If the postestative condition depends solely upon
the will of the debtor then conditional obligation is void (Art. 1182). Its
validity and compliance were left to the will of the debtor therefore it
cannot be legally demanded.
c. If the debtor promises to pay when he becomes a CPA;
