The principle of caveat emptor states that the buyer alone is responsible for checking the quality and
suitability of goods before a purchase is made.
The legal basis for product liability has two bases, tort law and contract law. The tort law stated that
anyone who manufactures or sells a product is liable to the buyer if the product is in a defective
condition that makes it unsafe to consume or use, even if the manufacturer or seller is unaware of the
deficiency of the product. The strict tort liability holds the seller and the manufacture fully accountable
for products up and down the supply chain, for any damages and injuries caused by the product.
